3. The legal basis for processing your data

Under the UK General Data Protection Regulation (UK GDPR), we must have a lawful basis for processing your personal information. Depending on the situation, we rely on one or more of the following:

1. Contractual obligation, where processing is necessary to perform a contract, for example when you engage us to sell or develop land.
2. Legal obligation, where we are required to process data to comply with the law, for example Anti-Money Laundering (AML) checks.
3. Legitimate interest, where we process data for a valid business reason that does not unfairly affect your rights, for example responding to land and development enquiries.
4. Consent, where you have given explicit consent, for example opting into marketing. You can withdraw consent at any time.

4. The information we collect and use

We only collect what we need to provide our services. What we process depends on how you interact with us.

Making an enquiry or request. We collect your name, email address, phone number, current address, and details of your land, property or project. We collect it when you complete an enquiry form, book a valuation, call, email or meet us. We use it to respond to your enquiry, prepare an appraisal, and provide relevant information.

Working with us on a sale or development. We collect your name, contact details, property and site documentation, and details relevant to the instruction. We collect it directly from you throughout the process. We use it to deliver the appraisal, planning and sale or development work under a formal agreement.

Meeting regulatory requirements. Where a transaction proceeds, we collect identification, address history and related information. We use it to meet regulatory requirements, including Anti-Money Laundering checks.

5. Sharing your information

We only share your personal information where necessary, and always in a limited, secure way. We may share data with planning consultants, architects, solicitors, conveyancers and mortgage brokers working on your instruction, with referencing or due-diligence agencies where required, with HM Revenue and Customs for regulatory compliance, and with law enforcement where the law requires it. We do not transfer your data outside the UK unless necessary, and where we do we ensure appropriate safeguards are in place, such as UK-approved standard contractual clauses. We never sell your data.

6. How long we keep your data

We keep your personal data only as long as necessary to meet our legal, contractual and business obligations. General enquiries are retained for up to 12 months after last contact. Transaction data is retained for 6 years after the end of the transaction for regulatory compliance. Anti-Money Laundering documentation is retained for 5 years as required by law. Once data is no longer required, it is securely deleted or anonymised.

7. How we protect your data

We use appropriate safeguards, including secure servers and encrypted databases, access restrictions so that only authorised staff can view sensitive data, and regular security reviews and staff training on data protection.

8. Marketing and communications

We may send you relevant updates only with your consent. You can opt out at any time by using the unsubscribe link in our emails or by contacting us directly. We never sell or share your details for third-party marketing.

9. Your rights under UK law

You have the right of access to your data, the right to have it corrected, the right to erasure, the right to restrict processing, the right to data portability, the right to object to direct marketing or to processing based on legitimate interests, and rights in relation to automated decision-making.
